These Terms of Service ("Terms") govern your use of the website mcraetowing.com and the towing, recovery, roadside assistance, and related services provided by McRae Towing & Recovery LLC ("McRae Towing," "we," "us," or "our"). By accessing our website, requesting service, or otherwise doing business with us, you agree to these Terms.

Services

We provide towing, roadside assistance, winching and recovery, accident recovery, vehicle storage and impound-related services, junk vehicle removal, and related automotive assistance, subject to availability, equipment capability, road and weather conditions, and applicable law. Service descriptions on our website are for general information and do not guarantee that a particular job can be completed in every situation.

Service Requests and Dispatch

Requesting a tow or roadside service—by phone, website form, text message, or otherwise—does not by itself create a binding obligation for us to dispatch until we confirm the job. Arrival times are estimates only and may change due to traffic, weather, prior calls, access restrictions, or other circumstances beyond our control.

Pricing, Quotes, and Payment

Pricing typically depends on distance, vehicle type, equipment needed, time of day, wait time, recovery complexity, and other job-specific factors. When we provide a quote by phone or text, it is based on the information you give us at that time. Additional charges may apply if the actual conditions differ (for example: locked gates, incorrect address, winching, after-hours work, debris cleanup, dollies, or extended wait time).

Payment is due upon completion of service unless we agree otherwise in writing. We may require payment authorization or deposit before dispatching. Unpaid balances may result in storage holds, collection activity, or liens where permitted by Idaho law.

If you cancel after we have dispatched, or if we arrive and cannot complete service due to incorrect information, unsafe conditions, or lack of authorization, a trip, dry-run, or cancellation fee may apply.

Authorization, Keys, and Vehicle Access

By requesting service, you authorize us to enter the vehicle as reasonably necessary to secure it, prepare it for transport, and operate equipment needed for loading and unloading. You are responsible for providing keys, remotes, gate codes, and access permissions when required. We are not responsible for delays or inability to complete service caused by missing keys, restricted access, or third-party interference.

Personal Property and Vehicle Condition

Remove valuables and personal property when practical before towing. Inventory of contents is not guaranteed. We are not responsible for loss of or damage to personal property left in or on the vehicle except to the extent caused by our gross negligence or willful misconduct.

Vehicles involved in accidents, floods, mechanical failure, or recovery from soft ground or off-road conditions may already be damaged or unstable. Winching, uprighting, loading, and transport can involve further stress on the vehicle. We will use commercially reasonable care, but we do not guarantee that additional cosmetic or mechanical damage will not occur when such methods are reasonably required to perform the service.

Impound and Storage

Impounded or stored vehicles may be held at our storage location at 198 N Yellowstone Highway, Rigby ID 83442, or another facility we designate. Storage fees, administrative fees, and release requirements apply as allowed by law and our current rate practices. Call us for release hours, fees, and required documentation (such as proof of ownership, identification, and payment).

Vehicles remaining unpaid or unclaimed beyond periods required by Idaho law may be subject to lien sale or other disposition procedures permitted by statute. You remain responsible for accruing storage and related charges until lawful release or disposition.

Insurance and Third-Party Billing

If you ask us to bill an insurer, roadside membership, fleet account, or other third party, you remain primarily responsible for all charges if the third party declines, delays, or only partially pays. You agree to provide claim numbers, policy information, and authorizations needed for billing, and to pay any deductible or uncovered balance promptly.

Customer Safety Obligations

Stay clear of moving equipment, tow trucks, winch lines, and traffic lanes unless an operator directs otherwise. Do not stand behind or under a vehicle being loaded. Inform us of hazards at the scene (fuel leaks, airbags, unstable ground, livestock, etc.). We may decline or abort service if conditions are unsafe for our operators, the public, or the vehicle.

Website Use

You may use mcraetowing.com for lawful purposes to learn about our services and contact us. You agree not to misuse the site, attempt unauthorized access, scrape content in a way that harms site performance, submit false service requests, or interfere with security or operations. Website content is provided "as is" and may change without notice. Service availability, coverage areas, and rates shown online may not reflect real-time conditions.

SMS / Text Message Service

McRae Towing & Recovery LLC sends text message updates and responses to automotive customers about pricing and products offered at mcraetowing.com.

When you opt-in to the service, we may send you a message to confirm your signup. Message and data rates may apply. Message frequency varies. Text HELP for help. Text STOP to cancel. You can cancel this service at any time. Just text STOP to (208) 970-1119. After you send the message STOP to us, we will reply to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to join again, just sign up as you did the first time, and we will start sending you messages again.

If at any time you forget what keywords are supported, just text HELP to (208) 970-1119. After you send the message HELP to us, we will respond with instructions on how to use our service and how to unsubscribe.

The McRae Towing name, logos, website design, copy, photos, and other materials on mcraetowing.com are owned by us or our licensors and may not be copied, modified, or used for commercial purposes without our prior written consent, except for fair use or other rights allowed by law.

Limitation of Liability

To the fullest extent permitted by law, McRae Towing & Recovery LLC and its owners, employees, and agents are not liable for indirect, incidental, consequential, special, or punitive damages arising from website use or services, including lost profits, loss of use of a vehicle, or delay damages, even if advised of the possibility of such damages.

Our total liability for any claim arising from a particular service job will not exceed the amount you paid us for that job, except where liability cannot be limited under applicable law (including claims for gross negligence, willful misconduct, or bodily injury to the extent such limits are prohibited).

Indemnification

You agree to indemnify and hold harmless McRae Towing & Recovery LLCand its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, inaccurate information, lack of authority to request service, or unlawful use of our website or services, except to the extent caused by our gross negligence or willful misconduct.

Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. You agree that exclusive venue for disputes arising from these Terms or our services will be in the state or federal courts located in Idaho, unless another forum is required by law.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will change when we do. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
